WritSpark provides an AI-powered content generation platform that helps marketing teams create on-brand copy, ads, emails, blog posts, and other marketing materials. Our Services include web-based applications, APIs, integrations, and related tools.

To use our Services, you must create an account. You agree to:

• Maintain and update your account information

• Accept responsibility for all activity under your account

Your Content: You retain full ownership of all content you upload, create, or generate using our Services. By using our Services, you grant us a limited license to process your content solely to provide the Services.

Our Services: WritSpark and its licensors own all rights, title, and interest in the Services, including all software, algorithms, interfaces, trademarks, and documentation. You may not copy, modify, reverse engineer, or distribute any part of the Services.

You agree not to use the Services to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe upon the intellectual property rights of others
• Distribute spam, phishing, or misleading content
• Attempt to gain unauthorized access to our systems
• Use the Services to build a competing product

7. AI-Generated Content

Content generated by WritSpark is created using artificial intelligence and may not always be accurate, complete, or appropriate. You are responsible for reviewing and editing all AI-generated content before use. We do not guarantee that generated content is free from errors, bias, or unintended similarities to existing works.

8. Limitation of Liability

To the maximum extent permitted by law, WritSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless WritSpark, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in activities that harm our Services or other users. Upon termination, your right to use the Services ceases immediately. We will provide 30 days' notice for terminations not related to Terms violations.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
